Terms and Conditions
Welcome to the (mawatershow.com) platform, an electronic platform specialized in marketing cars from dealerships and car showrooms, managed in the State of Qatar by (Tailma Tech QFZ LLC), Commercial Registration No. (FZA581).
By registering on the platform or using it in any way as a subscriber or user, you fully and unconditionally acknowledge and agree to comply with this agreement. This agreement constitutes a legally binding contract between you and the platform management.
Definitions
For the purposes of this agreement, the following terms shall have the meanings set forth next to each:
- Platform: The (mawatershow.com) website and all its services, applications, and digital display methods.
- Subscriber: The car dealership, company, or entity that creates an account on the platform and publishes its content through it.
- User: Any natural or legal person who visits or uses the platform or views its content.
- Content: Includes all texts, images, offers, prices, specifications, videos, data, and links added by the subscriber.
Subscriber Agreement
Subscriber Obligations
- The subscriber is solely responsible for the accuracy, correctness, and timeliness of all data, offers, and prices published through the platform.
- The subscriber must ensure that all prices and offers are licensed and approved by the relevant governmental authorities in the country (such as the Ministry of Commerce and Industry or other related authorities).
- The subscriber must update their data periodically and not leave any expired or misleading content for users.
- The subscriber must not publish any content that violates state laws, public order, or public morals.
- The subscriber acknowledges that they are the legitimate owner or licensed to use all materials (images, texts, videos) published on the platform.
- The subscriber guarantees that the content does not infringe on intellectual property rights, trademarks, or rights of any third party.
- The subscriber agrees that the platform is not responsible for any dispute arising between them and users or clients, and the relationship is direct between them.
- The subscriber grants the platform a non-exclusive license to use, archive, and display their content, even after the subscription ends, for documentation purposes.
- The subscriber acknowledges they are not entitled to any financial or moral compensation due to their content being on the platform or its removal.
- The subscriber bears full responsibility for any legal violations, claims, or complaints arising from their content.
Platform Obligations
- The platform undertakes to display the content as provided by the subscriber without substantial modification while retaining the right to remove any content violating the terms of this agreement.
- The platform is committed to protecting the personal data of users and subscribers according to applicable local laws.
- The platform works to provide the service in the best possible manner but does not guarantee uninterrupted service or freedom from technical errors.
- The platform provides its services “As-Is” without any express or implied warranties.
Content and Copyright
- The subscriber grants the platform the right to display, publish, and market their content (including images, texts, videos, offers, prices) on the platform and its marketing channels.
- The subscriber remains the original owner of all rights in the content, but once uploaded to the platform, they grant a free non-exclusive license to use this content within the platform’s services.
- The subscriber is not entitled to any financial or moral compensation for displaying, publishing, or marketing their content through the platform or its channels.
- The subscriber acknowledges that their content on the platform is with their full consent and may not claim against the platform regarding compensation, losses, or expected profits.
- If the subscriber deletes or cancels their subscription, the platform has the right to retain an archival copy of the content for legal or regulatory purposes only.
Responsibilities and Disclaimer
- The platform is not a party to any sales or purchases between dealerships and clients.
- The platform is not responsible for the accuracy, legality, or correctness of content published by subscribers.
- The platform is not responsible for any purchase decisions or transactions made between a user and a subscriber based on published information.
- The platform is not responsible for any direct or indirect losses or damages arising from the use of the platform or reliance on its content.
- The platform is not responsible for technical malfunctions, service interruptions, or data loss, and neither the subscriber nor the user may claim any compensation.
- The platform is not responsible for any external links added by subscribers and does not guarantee the safety or legality of their content.
- The platform is not responsible for arranging or highlighting content equally; editorial control is a fundamental right of the platform.
- Any transaction or sale agreement must be made directly between the platform user and the subscriber; the platform does not intervene or guarantee the deal.
Prices and Offers
- The subscriber is fully responsible for ensuring that all prices and offers published on the platform are licensed and approved by the relevant governmental authorities.
- The platform is not responsible for any legal violations or claims arising from publishing unlicensed prices or offers.
Intellectual Property
- All design, programming, and trademark rights of the platform are exclusively owned by the company that owns the platform.
- No party may reuse, reproduce, copy, or distribute any part of the platform without prior written permission.
Subscription Prices
The platform has the right to modify subscription prices with notification to subscribers upon any change.
Indemnification
The subscriber agrees to indemnify and protect the platform, its owners, and employees from any claims, losses, or costs (including attorney fees) arising from:
- The subscriber’s violation of this agreement.
- Any claim that the content published by them infringes the rights of a third party.
Legal Disputes
- Any dispute or disagreement should initially be attempted to be resolved amicably between the parties.
- If amicable resolution fails, the competent courts in the country shall have jurisdiction over the dispute.
Amendments to the Agreement
The platform reserves the right to modify or update this agreement at any time without prior notice. Continued use of the platform after publishing modifications constitutes explicit consent to them.
Termination of Subscription
- The platform has the right to terminate or suspend any subscriber’s account that violates the terms of this agreement.
- The subscriber is not entitled to any financial or moral compensation upon termination or suspension of their account.
Acceptance
By using the platform or registering as a subscriber/user, you fully acknowledge and agree to this agreement in all its terms and bear full legal responsibility for any violation.
User Agreement
Acceptance of Terms
- By using the (mawatershow.com) platform, you agree to comply with these Terms of Use.
- If you do not agree with any part of this agreement, please stop using the platform immediately.
Platform Usage
- The platform is intended to display car information and offers provided by car dealerships, showrooms, and licensed partners.
- Your use of the platform is limited to personal and non-commercial purposes, and you may not exploit its content in violation of the law or the rights of others.
- Unauthorized access or causing harm to the platform or its systems is prohibited.
Content and Information
- All data (car specifications, prices, images, offers) is provided by advertisers.
- The platform management is not responsible for the accuracy, completeness, or updates of this data, and users should verify before making any purchase decisions.
- Displayed images and videos are for illustrative purposes only and may differ from reality.
Liability
- The platform management is not responsible for any loss or damage resulting from a user relying on published information.
- Users should personally inspect the vehicle or product and verify details directly with the advertiser or seller.
External Links
- The platform may contain links to other websites, and the platform management is not responsible for the content or policies of those sites.
Intellectual Property Rights
- All texts, designs, images, and logos displayed on the platform are owned by the platform management or their respective owners and may not be reused without prior written permission.
Data Protection
- The platform may collect some basic data (such as cookies or browsing data) to improve the experience.
- By using the platform, you agree to its privacy policy.
Amendments
- The platform management has the right to modify or update this agreement at any time without prior notice, and continued use constitutes implied acceptance of these amendments.
Governing Law
This agreement is governed by and interpreted in accordance with the laws of the State, and any dispute falls under the jurisdiction of the country’s courts.

مرحبًا بكم في منصة (mawatershow.com)، وهي منصة إلكترونية متخصصة في تسويق سيارات وكالات ومعارض السيارات، وتديرها في دولة قطر شركة (Tailma Tech QFZ LLC) سجل تجاري رقم (FZA581).
من خلال التسجيل في المنصة أو استخدامها بأي شكل كمشترك أو كمستخدم، فإنك تقر وتوافق بشكل كامل وغير مشروط على الالتزام بهذه الاتفاقية، وتعتبر هذه الاتفاقية عقدًا ملزمًا قانونيًا بينك وبين إدارة المنصة.
التعريفات
لأغراض هذه الاتفاقية، يقصد بالمصطلحات التالية المعاني الموضحة قرين كل منها:
- المنصة: موقع (mawatershow.com) الإلكتروني وجميع خدماته وتطبيقاته ووسائل عرضه الرقمية.
- المشترك: وكالة السيارات أو الشركة أو الجهة التي تقوم بإنشاء حساب على المنصة ونشر محتواها عبرها.
- المستخدم: أي شخص طبيعي أو اعتباري يقوم بزيارة أو استخدام المنصة أو الاطلاع على محتواها.
- المحتوى: يشمل كافة النصوص، الصور، العروض، الأسعار، المواصفات، الفيديوهات، البيانات والروابط التي يضيفها المشترك.
اتفاقية المشترك
التزامات المشترك
- المشترك هو المسؤول الوحيد عن دقة وصحة وحداثة جميع البيانات والعروض والأسعار التي يقوم بنشرها عبر المنصة.
- يلتزم المشترك بأن جميع الأسعار والعروض المقدمة مرخّصة، وحاصلة على الموافقات والتصاريح من الجهات الحكومية المختصة في الدولة (مثل وزارة التجارة والصناعة أو غيرها من الجهات ذات العلاقة).
- يلتزم المشترك بتحديث بياناته بشكل دوري، وعدم ترك أي محتوى منتهي الصلاحية أو مضلل للمستخدمين.
- يلتزم المشترك بعدم نشر أي محتوى مخالف لقوانين الدولة أو النظام العام أو الآداب العامة.
- المشترك يقر بأنه المالك الشرعي أو المرخص له باستخدام جميع المواد (صور، نصوص، فيديو) التي ينشرها على المنصة.
- المشترك يضمن أن المحتوى لا ينتهك حقوق الملكية الفكرية أو العلامات التجارية أو حقوق أي طرف ثالث.
- المشترك يوافق على أن المنصة غير مسؤولة عن أي نزاع ينشأ بينه وبين المستخدمين أو العملاء، وتكون العلاقة مباشرة بينهما.
- المشترك يمنح المنصة ترخيصًا غير حصري لاستخدام وأرشفة وعرض محتواه، حتى بعد انتهاء الاشتراك، لأغراض توثيقية.
- المشترك يقر بعدم أحقية المطالبة بأي تعويضات مالية أو معنوية بسبب وجود محتواه في المنصة أو إزالته منها.
- المشترك يتحمل المسؤولية الكاملة عن أي مخالفات قانونية أو دعاوى أو شكاوى تنشأ بسبب محتواه.
التزامات المنصة
- تلتزم المنصة بعرض المحتوى كما يقدمه المشترك دون تعديل جوهري، مع احتفاظها بحق إزالة أي محتوى مخالف لشروط هذه الاتفاقية.
- تلتزم المنصة بحماية البيانات الشخصية للمستخدمين والمشتركين وفقًا للقوانين المحلية السارية في الدولة.
- المنصة تعمل على توفير الخدمة بأفضل صورة ممكنة، لكن لا تضمن استمرارية الخدمة دون انقطاع أو خلوها من الأخطاء التقنية.
- تقدم المنصة خدماتها كما هي (As-Is) دون أي ضمانات صريحة أو ضمنية.
المحتوى وحقوق النشر
- يمنح المشترك المنصة حق عرض ونشر وتسويق المحتوى الخاص به (بما في ذلك الصور، النصوص، الفيديوهات، العروض، الأسعار) على المنصة وقنوات التسويق التابعة لها.
- يظل المشترك المالك الأصلي لجميع حقوقه في المحتوى، ولكن بمجرد رفعه على المنصة فإنه يمنحنا ترخيصًا مجانيًا غير حصري لاستخدام هذا المحتوى في حدود خدمات المنصة.
- لا يحق للمشترك المطالبة بأي تعويضات مالية، أو معنوية مقابل عرض، أو نشر أو تسويق محتواه عبر المنصة او قنواتها.
- يقر المشترك أن وجود محتواه على المنصة هو بموافقته الكاملة، ولا يجوز له الرجوع على المنصة بأي دعاوى تتعلق بالتعويض أو الخسائر أو الأرباح المتوقعة.
- في حال قام المشترك بحذف أو إلغاء اشتراكه، يحق للمنصة الاحتفاظ بنسخة أرشيفية من المحتوى لأغراض قانونية أو تنظيمية فقط.
المسؤوليات وإخلاء المسؤولية
- المنصة ليست طرفًا في عمليات البيع أو الشراء بين الوكالات والعملاء.
- المنصة غير مسؤولة عن صحة أو دقة أو قانونية المحتوى المنشور من قبل المشتركين.
- المنصة غير مسؤولة عن أي قرارات شراء أو تعاملات تتم بين المستخدم والمشترك بناءً على المعلومات المنشورة.
- المنصة غير مسؤولة عن أي خسائر أو أضرار مباشرة أو غير مباشرة تنشأ نتيجة استخدام المنصة أو الاعتماد على محتواها.
- المنصة غير مسؤولة عن الأعطال التقنية، أو توقف الخدمة، أو فقدان البيانات، ولا يحق للمشترك أو المستخدم المطالبة بأي تعويضات.
- المنصة غير مسؤولة عن أي روابط خارجية تتم إضافتها من قبل المشتركين، ولا تضمن سلامة أو شرعية محتواها.
- المنصة غير مسؤولة عن ترتيب أو إبراز المحتوى بشكل متساوٍ، والتحكم التحريري حق أصيل للمنصة.
- أي تعامل أو اتفاق بيع يجب ان يتم بين المستخدم للمنصة والمشرك مباشرة، والمنصة لا تتدخل ولا تضمن الصفقة.
الأسعار والعروض
- المشترك مسؤول مسؤولية كاملة عن أن جميع الأسعار والعروض المنشورة على المنصة مرخّصة ومصرح بها من الجهات الحكومية المختصة في الدولة.
- المنصة غير مسؤولة عن أي مخالفة قانونية أو دعوى تنشأ بسبب نشر أسعار أو عروض غير مرخصة.
الملكية الفكرية
- جميع حقوق التصميم والبرمجة والعلامة التجارية الخاصة بالمنصة مملوكة حصريًا للشركة المالكة للمنصة.
- لا يحق لأي طرف إعادة استخدام، أو استنساخ، أو نسخ، أو توزيع أي جزء من المنصة دون إذن خطي مسبق.
أسعار الاشتراكات
المنصة لها الحق في تعديل أسعار الاشتراكات مع إخطار المشتركين عند التعديل.
التعويض
يوافق المشترك على تعويض وحماية المنصة ومالكيها وموظفيها من أي دعاوى أو خسائر أو تكاليف (بما في ذلك أتعاب المحاماة) تنشأ بسبب:
- مخالفة المشترك لهذه الاتفاقية.
- أي ادعاء بأن المحتوى المنشور من قبله ينتهك حقوق طرف ثالث.
النزاعات القانونية
- يتم في البداية محاولة حل أي نزاع أو خلاف بشكل ودي بين الأطراف.
- في حال تعذر الحل الودي، تكون المحاكم المختصة في الدولة هي الجهة المخولة بالفصل في النزاع.
التعديلات على الاتفاقية
تحتفظ المنصة بحق تعديل أو تحديث هذه الاتفاقية في أي وقت دون إشعار مسبق. ويعتبر استمرار استخدام المنصة بعد نشر التعديلات موافقة صريحة عليها.
إنهاء الاشتراك
- يحق للمنصة إنهاء أو تعليق اشتراك أي مشترك يخالف شروط هذه الاتفاقية.
- لا يحق للمشترك المطالبة بأي تعويض مالي أو معنوي عند إنهاء أو تعليق حسابه.
القبول
باستخدامك للمنصة أو تسجيلك كمشترك / مستخدم، فإنك تقر وتوافق بشكل كامل على هذه الاتفاقية بجميع بنودها، وتتحمل كامل المسؤولية القانونية المترتبة على مخالفتها.
اتفاقية المستخدم
القبول بالشروط
- باستخدامك لمنصة (mawatershow.com) فإنك توافق على الالتزام بشروط الاستخدام هذه.
- إذا لم تكن موافقاً على أي جزء من هذه الاتفاقية، يرجى التوقف عن استخدام المنصة فوراً.
استخدام المنصة
- المنصة مخصصة لعرض معلومات السيارات والعروض المقدمة من وكالات السيارات والمعارض والشركاء المرخصين.
- استخدامك للمنصة يقتصر على أغراض شخصية وغير تجارية، ولا يحق لك استغلال محتوياتها بشكل يخالف القانون أو حقوق الغير.
- يُمنع محاولة الدخول غير المصرح به أو إلحاق الضرر بالمنصة أو أنظمتها.
المحتوى والمعلومات
- جميع البيانات (مواصفات السيارات، الأسعار، الصور، العروض) يتم توفيرها من قبل المعلنين.
- إدارة المنصة غير مسؤولة عن دقة أو اكتمال أو تحديث هذه البيانات، ويجب على المستخدم التحقق بنفسه قبل اتخاذ أي قرار شراء.
- الصور والفيديوهات المعروضة هي لأغراض توضيحية فقط وقد تختلف عن الواقع.
المسؤولية
- إدارة المنصة غير مسؤولة عن أي خسارة أو ضرر ينتج عن اعتماد المستخدم على المعلومات المنشورة.
- على المستخدم القيام بالفحص الشخصي للمركبة او المنتج المعروض والتأكد من التفاصيل مع المعلن أو البائع مباشرة.
الروابط الخارجية
- قد تحتوي المنصة على روابط لمواقع أخرى، وإدارة المنصة غير مسؤولة عن محتوى أو سياسات تلك المواقع.
حقوق الملكية الفكرية
- جميع النصوص، التصاميم، الصور، والشعارات المعروضة في المنصة هي ملك لإدارة المنصة أو للجهات المالكة لها، ولا يجوز إعادة استخدامها دون إذن خطي مسبق.
حماية البيانات
- قد تقوم المنصة بجمع بعض البيانات الأساسية (مثل الكوكيز أو بيانات التصفح) لتحسين التجربة.
- باستخدامك للمنصة فإنك توافق على سياسة الخصوصية الخاصة بها.
التعديلات
- يحق لإدارة المنصة تعديل أو تحديث هذه الاتفاقية في أي وقت دون إشعار مسبق، ويُعتبر استمرارك في استخدام المنصة موافقة ضمنية على هذه التعديلات.
القانون المطبق
تخضع هذه الاتفاقية وتفسر وفقاً لقوانين الدولة، وأي نزاع يختص به قضاء الدولة.
